Has Gideon’s Promise Been Fulfilled?

Abstract

This column discusses the current crisis in defense systems serving indigent clients and efforts to improve those systems. It also analyzes the legal standard for adequate assistance of counsel in light of the ethical duties of defense counsel, whether appointed counsel, public defenders, or private attorneys. It examines whether Gideon's promise is being fulfilled by counsel and protected by the courts.
