The Alternative Perpetrator Strategy

Abstract

This column will review the ethical and evidentiary rules that bear on defense use of an alternative perpetrator strategy and explore a defense lawyer's conduct in two contexts-when the defense lawyer does not know if the defendant committed the charged offense and when the lawyer does know the defendant committed the offense.
