Prison Searches and Seizures: “Locking” the Fourth Amendment Out of Correctional Facilities

Abstract

This article evaluates the various approaches that courts have utilized to decide issues involving the fourth amendment rights of prisoners. It then proposes a model for the future analysis of prison searches and applies this model to search and seizure practices commonly employed in the institutional environment.
